Legal Marriage Requirements

The service may be simple, but the legal requirements still matter.

The basic checklist

For a legal marriage in Sydney, you usually need:

  • both parties to be 18 or older
  • both parties to be legally free to marry
  • a valid NOIM
  • at least one calendar month notice in most cases
  • proof of identity and date and place of birth
  • evidence of any previous marriage ending
  • two witnesses aged 18 or over
  • an in-person marriage with an authorised celebrant

Documents

You will normally need:

  • a passport, or
  • a birth certificate plus photo ID
  • translations for any non-English documents
  • divorce papers or a death certificate if relevant

You both need to be there in person.

So do your two witnesses.

The marriage cannot happen online.

After the marriage

We lodge the paperwork after the signing.

Later, you can order your official marriage certificate from NSW Births, Deaths and Marriages.
